Selon un communiqué de presse du département de police de Winder, les suspects ont été arrêtés mercredi à la suite de l’exécution de six mandats de perquisition en matière de drogue. Plus de 150 agents ont exécuté les mandats simultanément dans six résidences Winder.

Le département de police de Winder a demandé l’aide du Georgia Bureau of Investigation Appalachian Drug Enforcement Office en mai de cette année. L’ARDEO et le GBI Gang Task Force ont fourni des agents et une assistance dans l’enquête.

Au cours de leur enquête, des agents infiltrés ont acheté des drogues illégales, notamment des pilules à base d’opioïdes, de l’héroïne, du crack, de la cocaïne en poudre, de l’ecstasy, de la méthamphétamine et de la marijuana.

Après une enquête de plusieurs mois, les policiers ont rassemblé suffisamment de preuves pour exécuter 136 mandats d’arrêt contre 28 personnes. Selon le communiqué, la majorité des accusés sont accusés de vente de stupéfiants illégaux. D’autres accusations incluent le trafic de cocaïne, la vente de stupéfiants illégaux dans un rayon de 1 000 pieds d’un terrain d’habitation, la violation du statut des gangs en Géorgie, la possession dans l’intention de distribuer de la cocaïne et de la marijuana et la violation de la probation. Mercredi, lors de l’exécution des mandats de perquisition, les agents ont saisi de la cocaïne, de l’ecstasy, de la marijuana, de l’argent liquide et une arme à feu possédée par un criminel reconnu coupable.

En droit administratif, les informateurs sont considérés comme des « collaborateurs occasionnels de justice », selon la qualification du Conseil d’Etat. A ce titre, un indic peut théoriquement bénéficier de la protection fonctionnelle, au même titre qu’un agent public. L’administration dont il dépend le protège donc de condamnations civiles ou pénales pour des faits commis en raison de ses fonctions, sauf, comme pour n’importe quel agent public, s’il a commis « une faute personnelle », «  détachable du service ». Jusqu’ici, les cas dont la justice a eu à débattre ont tous été considérés comme des fautes personnelles.
 
En 2017, un arrêt du Conseil d’Etat a définitivement scellé le sort d’un célèbre aviseur de la douane, Marc Fiévet, utilisé comme un agent infiltré à de nombreuses reprises. Tout en reconnaissant qu’il avait permis l’arrestation de plusieurs trafiquants ainsi que la saisie de quantités importantes de produits stupéfiants et des moyens de locomotion ayant servi à leurs transports, la justice estime que la France n’a pas à l’indemniser pour ses années de prison. Marc Fiévet avait été condamné, en 1996 en Grande-Bretagne à quatre ans d’emprisonnement du chef de « conspiration dans le but de faire entrer du cannabis sur le territoire anglais » et, en 1997 au Canada, à la réclusion criminelle à perpétuité pour « complot d’importation de stupéfiants » après avoir plaidé coupable. Il avait été transféré en France en 1998 où il est resté en prison, jusqu’en 2005.
 
Pour cet aviseur de haut niveau, le trafic dont il a été accusé n’est que la résultante de son travail aux services des douanes.

En 2008, Marc Fiévet demande une indemnisation de 91 million d’euros pour les préjudices subis. La demande et tous ses recours sont rejetés. La décision définitive tombe en 2017. Le Conseil d’Etat estime que si l’implication croissante de l’aviseur dans un réseau de trafiquants de drogue a été « encouragée à l’origine par l’administration des douanes », les faits pour lesquels il avait été condamné étaient « dépourvus de tout lien avec les fonctions exercées en sa qualité d’informateur de l’administration des douanes et étaient donc détachables du service ».

La cour déduit donc que les condamnations de Marc Fiévet et ses années de prison sont la cause « d’une faute personnelle » et que l’administration n’a pas à lui accorder le bénéfice de la protection fonctionnelle.

ÉTATS UNIS 🇺🇸 (New York) : l’ancien directeur général de Citgo a aidé à blanchir l’argent de la drogue vénézuélienne, selon le témoignage d’un témoin

C’est Luc Cohen, dans BOURSORAMA qui rapporte qu’un témoin coopérant dans un procès pénal débutant la semaine prochaine devrait témoigner qu’un ancien directeur général du raffineur de pétrole américain Citgo Petroleum a aidé un trafiquant de drogue vénézuélien présumé à blanchir de l’argent au milieu des années 2000, selon des documents judiciaires.

Les procureurs dans le procès de Carlos Orense, qu’ils accusent d’avoir expédié des dizaines de milliers de kilogrammes de cocaïne aux États-Unis, n’ont pas nommé Citgo dans les documents judiciaires du 4 novembre, la décrivant seulement comme une filiale américaine à 100 % d’une société d’État vénézuélienne avec laquelle Orense avait des contrats de forage pétrolier.

Un avocat d’Hugo Carvajal, un ancien directeur du renseignement militaire vénézuélien qui fait l’objet d’accusations distinctes de trafic de drogue , a été cité par le Miami Herald mardi comme ayant déclaré que la société américaine était Citgo PDVSAC.UL et que le directeur général était Luis Marin. L’avocat n’a pas répondu aux demandes de commentaires.

Marin a été directeur général de Citgo de 2003 à 2005.

Lors de la sélection du jury lundi pour le procès d’Orense à New York, le juge du district américain Vernon Broderick a cité Marin comme l’une des nombreuses personnes qui devraient être mentionnées au cours du procès, qui pourrait durer jusqu’à deux semaines.

M. Marin a déclaré à Reuters qu’il n’était pas au courant de l’affaire et s’est refusé à tout autre commentaire.

Un porte-parole de Citgo s’est refusé à tout commentaire.

Des employés de Citgo – qui appartient à la compagnie pétrolière publique Petroleos de Venezuela PDVSA.UL – ont été accusés d’avoir commis des actes répréhensibles dans d’autres affaires. Un ancien responsable des achats a plaidé coupable en 2021 d’avoir accepté des pots-de-vin. Toutefois, aucun dirigeant de Citgo n’a jamais été accusé de complicité avec le trafic de drogue.

FONCTIONNAIRES VÉNÉZUÉLIENS ACCUSÉS D’AVOIR ACCEPTÉ DES POTS-DE-VIN

Orense est accusé d’avoir soudoyé des chefs militaires vénézuéliens pour assurer un passage sûr à sa drogue. Il a plaidé non coupable de trois chefs d’accusation de complot d’importation de stupéfiants et de possession d’armes criminelles.

Le ministère de l’information du Venezuela n’a pas répondu à une demande de commentaire.

Les procureurs n’ont pas nommé le témoin qui témoignera au sujet du directeur général, mais dans le dossier du 4 novembre, ils l’ont décrit comme un ancien membre du service de sécurité d’Orense de 2003 à 2010. Un agent de la Drug Enforcement Administration a écrit dans une plainte de 2021 contre Orense que le témoin a été condamné pour fraude aux États-Unis en 2015 et qu’il est payé pour coopérer avec les autorités.

OCÉAN ATLANTIQUE : les États-Unis toujours sur le « qui-vive »

C’est Narcodiario.net qui nous rapporte que la récente opération maritime dans l’océan Atlantique a mis en lumière les inquiétudes persistantes concernant le trafic de drogue sur les routes maritimes internationales.

Lors d’une opération en haute mer le 10 octobre, une frégate de l’ « US customs and border protection » équipée de radars performants a détecté une activité inhabituelle conduisant à l’interception de trois vedettes rapides.

Parmi elles, deux ont été saisies, tandis qu’une troisième a réussi à s’échapper.

L’incident, caractérisé par sa violence, a malheureusement entraîné la mort d’un individu, ce qui a donné lieu à une enquête judiciaire pour déterminer les circonstances exactes (ou qui seront présentées …) de cet événement.

L’opération a permis la saisie d’un nombre important de colis, pesant environ 40 kilos chacun, qui se trouvaient à bord des vedettes rapides. L’enquête vise à déterminer si la personne décédée est tombée de l’un des hors-bord lors de l’interception . Dans le même temps, deux individus qui faisaient partie de l’équipage des bateaux ont été arrêtés.
